The relationship between the EU and Switzerland for Asset Managers
Clerkin Lynch LLP will be staging a webinar in conjunction with AIMA with Fedor Poskriakov and Francois Rayoux of Lenz and Staehelin on the interaction of financial services and asset management in particular between Switzerland and the EU on January 20th 2022.
The jurisdictions have enjoyed a close synergistic relationship over many years, with Switzerland being one of the largest distribution markets for EU domiciled funds and Swiss asset managers also being amongst the largest users of these vehicles.
However relatively recent regulatory developments including the new Financial Services Law in Switzerland as well as elements of MiFID 2 in the EU may be impacting on this and the webinar will explore this changing landscape as well as some specific issues that have arisen.

THE EVOLVING NATURE OF FUND DIRECTOR’S RESPONSIBILITIES – D+O INSURANCE CONSIDERATIONS
Mark Browne and Niall Clerkin of Clerkin Lynch LLP will be joined by Nick Bachmann of Cooper Gay to explore the evolving nature of the role of the funds director and its responsibilities. The session will explore the growing litigation and enforcement paradigm within which directors are operating, recent case law relating to director’s duties and then focus on how directors can protect themselves, including a focus on considerations pertaining to D&O insurance.
